Dennison et al v Stanton and Anor

In this case the plaintiff landlord obtained summary judgment against the directors of a tenant company principally for unpaid rent following default under the lease. The matter, while at one level a routine smallish commercial dispute, involved significant questions of interpretation of a guarantee and indemnity, an alleged set of a breach of the covenant of quiet and enjoyment, and of the status of directors to take the benefit of a claim belonging a deregistered company. The successful application and judgment are an example of practical and effective resolution of a dispute that would otherwise have required significant resources to litigate at a full trial.
