SA Superannuation Board (Super SA) v McIntyre  SASCFC 57
Mr McIntyre sought an invalidity insurance benefit and early release of his superannuation entitlements under the Southern State Superannuation Act 1994 (SA). He succeeded in the District Court (sitting in its Administrative and Disciplinary Division). On appeal by SuperSA he held the decision, despite a finding that he had not demonstrated an element of the statutory criteria. The issue had not been raised at first instance, and the Court held that the appellant should not be permitted to raise the issue for the first time on appeal.
